Digital Frenzy Terms and Conditions

DigitalFrenzy.net, hereafter referred to as Digital Frenzy, allows visitors of the website to upload image files to Digital Frenzy servers free of charge. As an unregistered member of Digital Frenzy you agree to be bound by the same terms of service. Please review the following terms of service closely.
Registered Members
DigitalFrenzy.net, hereafter referred to as Digital Frenzy, allows registered members to create online photo albums by uploading image files to Digital Frenzy servers. As a Digital Frenzy member you agree to receive periodic emails from Digital Frenzy containing information about your account; new features being added and service options and/or periodic information about special promotions.
Digital Frenzy is not responsible for content posted by any Digital Frenzy registered members or website visitors that use our services to host their images. Digital Frenzy does not verify or endorse any content posted by its members or users. Digital Frenzy is not responsible for the delivery or quality of any goods or services that are advertised by its members on Digital Frenzy. If you believe that any of the content posted by Digital Frenzy members or visitors violates your proprietary rights including copyrights please report it by clicking on the Contact Us link on the Digital Frenzy homepage.
You must be at least 13 years old to sign up/register as a Digital Frenzy member. As a Digital Frenzy member or visitor that uses our services -- you are solely and fully responsible for any content posted by you. Although we do review all registered members account content on a spot check basis we cannot establish nor guarantee the legal nature of any such content.
We prohibit the posting of the following content in any Digital Frenzy member's account or visitor uploaded:
– nudity, pornography, and sexual material of a lewd, lecherous or obscene nature or intent or that violates local, state or national laws.
– any material that violates or infringes in any way upon the proprietary rights of others including, without limitation, copyright or trademark rights.
– any material that is threatening, abusive, harassing, slanderous, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, indecent, or otherwise objectionable including posting private information belonging to or about other individuals.
– content that promotes, encourages, or provides instructional information about illegal activities.
– hate propaganda or hate mongering, swearing, or fraudulent material or activity.
By submitting your photos to Digital Frenzy, you represent that the photos, titles and descriptions comply with the Terms and Conditions of Use set forth in this section. If any third party brings a claim, lawsuit or other proceeding against Digital Frenzy based on content you post on Digital Frenzy, you agree to compensate Digital Frenzy including its officers, directors, employees and agents for any and all losses, liabilities, damages or expenses including attorney's fees incurred by Digital Frenzy in connection with any such claim, lawsuit or proceeding.
Digital Frenzy is the final arbiter of what is allowed and not allowed on the Digital Frenzy website. If a portion of the content in an account is found to be in violation of the Terms and Conditions of Use set forth in this section, the entire account may be removed. The account holder also may receive a ban from accessing DigitalFrenzy.net website and/or services, there will be no warning email or further correspondence between the users or individual due to the violation of the Digital Frenzy Terms and Conditions of Use set forth in this section.
Digital Frenzy reserves the right to modify or remove any content in a registered members account or to delete a none members photos at any time without prior notice if that user/account violates the Terms and Conditions of Use set forth in this section.
Digital Frenzy is not responsible for any financial or personal loss to users or members using the Digital Frenzy services for business or any other purpose for any reason including but not limited to server down situations and accidental or willful deletion of any member accounts and/or contents of said accounts.
Images stored on Digital Frenzy servers are for online photo sharing purposes and not meant for permanent or temporary archival purposes. Therefore, Digital Frenzy is not obligated to maintain back-up copies of any material submitted or posted on Digital Frenzy; this policy applies to free basic accounts as well as to registered accounts.
Digital Frenzy is not responsible or liable for any monetary losses incurred by members using their accounts for either personal or business, marketing or any other commercial purpose for any reason including but not limited to server malfunction, server crashes or software related problems.
Digital Frenzy members that have not logged into their account at least once every 12 months will have their albums deleted. If you wish to make sure your account and its images will not be deleted, please be sure to login and add content to your gallery to prevent any loss.
In order to terminate an account the member should click on the Contact Us link on the main page and submit a cancellation request. The account will then be terminated within two business days after we have verified the account holder.
